The Commonwealth Lawyers’ Association has expressed concerns with the recommendations by the Judicial Service Commission in which it is suggested that Supreme Court judge Esther Kisakye is dropped due to alleged misconduct.
The CLA has written to President Museveni a letter denouncing the move declaring it unconstitutional.
“The Commonwealth Lawyers’ Association (CLA) is gravely concerned about reports that the Judicial Service Commission in Uganda has recommended the removal of Supreme Court Justice Esther Kisakye from office. Judges should be subject to suspension or removal for only reasons of incapacity or misbehavior that clearly renders them unfit to discharge their duties,” the CLA statement reads.
The CLA since called on president Museveni not to heed to the recommendations by the Judicial Service Commission to drop justice Kisaakye.
“Therefore, the CLA urges the President Yoweri Museveni to carefully consider the implications for the independence of the judiciary in having a judge removed in this manner,” the statement reads.
Justice Kisaakye fell out with the Chief Justice in 2021 during the judgement of the presidential election petition. Kisaakye had given a dissenting judgement that nullified the election of President Museveni citing malpractice among other issues raised by the petitioners of NUP presidential candidate Kyagulanyi Ssentamu Robert aka Bobi Wine.
